These Terms and Conditions (“Terms”) form a legally binding contract between you (the “Student”, “Center Partner”, or “User”) and NXT GEN Skill Development Institute (“NXT GEN SDI”), functioning in association with Bit Byte Fly Private Limited, having its head operating address at 2nd Floor, Agrasen Market, New Patliputra Colony, Beur, Anishabad, Patna - 800002, Bihar, India.

By creating an account, enrolling into any certificate or diploma course, affiliating your institute, or utilizing our public verification registry, you confirm that you have attained the age of majority (or possess authorized parental/guardian consent if under 18) and possess full legal capacity to enter into this contract.

If you disagree with any portion of these Terms, you must immediately cease accessing or using our services.

NXT GEN SDI provides professional, vocational, and technical skill enhancement courses across sectors including Information Technology, Web & Software Engineering, Digital Marketing, Fire & Safety, Cosmetology & Beauty, Electrical Trades, Hardware, and Computer Applications.

• Curriculum Adjustments: To keep coursework synchronized with evolving industrial benchmarks, NXT GEN SDI reserves the right to revise syllabus modules, instructors, lab equipment, or project assignments without prior notice.
• Safety in Trade Labs: Students participating in physical laboratory sessions (e.g. electrical wiring, cosmetology chemical applications, hardware repair) must strictly adhere to instructor safety guidelines, wear prescribed gear, and handle institute equipment responsibly.

To preserve the credibility of issued diplomas and certificates, every candidate must submit accurate, authentic details:

• Mandatory Profile Photo / Avatar: Students must upload a clear, recent portrait photo. This avatar appears directly on the official physical and digital marksheets/certificates. Submitting cartoon avatars, offensive images, or impersonations will result in profile rejection.
• Account Security: You are solely responsible for maintaining the confidentiality of your student portal credentials. Sharing accounts or attempting to proxy exams for another student is strictly forbidden.
• Eligibility Criteria: Certain advanced diplomas require minimum prerequisites (e.g. 10th/12th passing, prior IT proficiency). Enrolling under false academic claims invalidates any resulting credential.

Institutions accredited as Authorized Study Centers (“Affiliates”) operate under strict quality and compliance guidelines:

Course tuition, laboratory maintenance fees, examination registration fees, and center accreditation charges are subject to the following financial terms:

• Taxes: All fees are subject to applicable Goods and Services Tax (GST) as per Government of India directives.
• Payment Failures & Double Debits: In the event of an intermittent network failure where money is deducted from your bank without receipt generation, funds are typically reversed automatically by Razorpay/your bank within 5–7 banking business days.
• Installments: If an installment plan is agreed upon, failure to pay subsequent installments on schedule may result in portal account suspension.

Certification by NXT GEN SDI signifies authentic skill proficiency:

• Passing Criteria: Students must obtain the minimum qualifying aggregate score (typically 40% or as outlined per curriculum) in theory, viva, and practical trade laboratory assessments.
• Assessment Retakes: Candidates failing to achieve the qualifying threshold may apply for re-examination upon payment of the prescribed administrative re-test fee.
• Evaluation Integrity: Cheating, copying code or designs, proxy exam appearances, or tampering with online evaluation scripts leads to immediate disqualification.

Every certificate and marksheet issued by NXT GEN SDI is cataloged with an immutable unique registration code and encoded QR code.

• Employers, recruiters, and background verification agencies can verify credentials 24/7 on our public portal (/verify-certificate).
• Physical or digital documents lacking a corresponding entry in our central database are deemed counterfeit and illegitimate.
• NXT GEN SDI actively pursues legal prosecution against individuals or illicit organizations involved in manufacturing fake SDI marksheets or certificates.

All educational resources, lecture presentations, trade lab diagrams, code repositories, branding marks, logos, and UI designs hosted on the Platform are the exclusive intellectual property of NXT GEN SDI and Bit Byte Fly Private Limited.

Students and centers receive a limited, revocable, non-exclusive license for personal educational study only. Downloading video content for commercial distribution, screen recording live lectures for torrenting, or repackaging SDI courseware is strictly forbidden and subject to copyright infringement claims under the Copyright Act, 1957.

We maintain an inclusive, respectful, and safe learning environment. Users agree not to:

• Engage in harassment, verbal abuse, cyber-bullying, or discrimination against instructors, staff, or fellow students.
• Attempt to compromise platform security, reverse engineer source code, scrape data, or launch denial-of-service attacks.
• Upload malicious scripts, viruses, or unlawful content to portal discussion boards or assignment portals.

While NXT GEN SDI maintains partnerships with 350+ recruiters and provides active placement assistance, resume workshops, mock interviews, and drive invites:

Educational courses, web software, trade simulators, and platform services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

In no event shall NXT GEN SDI, Bit Byte Fly Private Limited, its directors, instructors, or affiliates be liable for indirect, incidental, punitive, or consequential damages resulting from technical downtime, network disruptions, or equipment failure. Under all circumstances, the aggregate financial liability of NXT GEN SDI shall not exceed the actual course fees received from the claimant for the disputed enrollment.

NXT GEN SDI reserves the right to immediately suspend or permanently terminate your portal access, expel a student from a batch, or recall issued certifications if:

• You submit counterfeit identification or fabricated educational degrees during admission.
• You participate in cheating or proxy test-taking during semester or final examinations.
• An affiliated partner center breaches quality norms, tampers with student records, or violates ethical standards.

These Terms shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India.

In the event of any dispute, difference, or claim arising out of or in connection with these Terms, student admissions, center affiliations, or certification verifications, the parties agree to make good-faith efforts to reach an amicable settlement. Should such efforts fail, the dispute shall be subject to the exclusive jurisdiction of the competent civil courts situated in Patna, Bihar, India.
